a.TheUniformRulesforCollections,1995Revision,ICCPublicationNo.522,shallapplytoallcollectionsasdefinedinArticle2wheresuchrulesareincorporatedintothetextofthe “ collectioninstruction ” referredtoinArticle4andarebindingonallpartiestheretounlessotherwiseexpresslyagreedorcontrarytotheprovisionsofanational,stateorlocallawand/orregulationwhichcannotbedepartedfrom.

ForthepurposesoftheseArticles: jiù běn tiáo kuǎn 'ér yán：
a.” Collection” meansthehandlingbybanksofdocumentsasdefinedinsub-Article2(b),inaccordancereceived,inorderto: tuō shōu shì zhǐ yínháng yǐ jù suǒ shōu dào de zhǐ shì chǔlǐ xià shù（ 2） kuǎn suǒ xiàn dìng de dān jù， yǐ biàn yú：
I.obtainpaymentand/oracceptance,or qǔ dé fù kuǎn hé / huò chéng duì； huò
II.deliverdocumentsagainstpaymentand/oragainstacceptance,or píng yǐ fù kuǎn huò chéng duì jiāo dān； huò
III.deliverdocumentsonothertermsandconditions. àn zhào qí tā tiáo kuǎn hé tiáo jiàn jiāo dān。
b.” Documents” meansfinancialdocumentsand/orcommercialdocuments: dān jù shì zhǐ jīn róng dān jù hé / huò shāng yè dān jù。
I.“ Financialdocuments” meansbillsofexchange,promissorynotes,cheques,orothersimilarinstrumentsusedforobtainingthepaymentofmoney;
jīn róng dān jù shì zhǐ huì piào、 běn piào、 zhī piào huò qí tā lèi shìde kě yòng yú qǔ dé kuǎn xiàng zhī fù de píng zhèng；
II.“ Commercialdocuments” meansinvoice,transportdocuments,documentsoftitleorothersimilardocuments,oranyotherdocumentswhatsoever,notbeingfinancialdocuments.
shāng yè dān jù shì zhǐ fā piào、 yùn shū dān jù、 suǒ yòu quán wén jiàn huò qí tā lèi shìde wén jiàn， huò zhě bù shǔ yú jīn róng dān jù de rèn hé qí tā dān jù。
c.” Cleancollection” meanscollectionoffinancialdocumentsnotaccompaniedbycommercialdocuments.
d.” Documentarycollection” meanscollectionof:
guāng piào tuō shōu shì zhǐ bù fù yòu shāng yè dān jù de jīn róng dān jù xiàng xià de tuō shōu。
I.financialdocumentsaccompaniedbycommercialdocuments;
fù yòu shāng yè dān jù de jīn róng dān jù xiàng xià de tuō shōu；
II.Commercialdocumentsnotaccompaniedbyfinancialdocuments.
bù fù yòu jīn róng dān jù de shāng yè dān jù xiàng xià de tuō shōu。
Article3 dì sān kuǎn tuō shōu de guān xì rén
a.ForthepurposesoftheseArticlesthe“ partiesthereto” are: jiù běn tiáo kuǎn 'ér yán， tuō shōu de guān xì rén yòu：
I.the“ principal” whoisthepartyentrustingthehandlingofacollectiontoabank;
wěi tuō rén jí wěi tuō yínháng bàn lǐ tuō shōu de yòu guān rén；
II.the“ remittingbank” whichisthebanktowhichtheprincipalhasentrustedthehandlingofacollection;
jì dān xíng jí wěi tuō rén wěi tuō bàn lǐ tuō shōu de yínháng；
III.“ collectingbank” whichisanybank,otherthantheremittingbank,involvedinprocessingthecollection;
dài shōu xíng jí chú jì dān xíng yǐ wài de rèn hé cānyù chǔlǐ tuō shōu yè wù de rèn hé yínháng；
IV.the“ presentingbank” whichisthecollectingbankmakingpresentationtothedrawee.
b.The“ drawee” istheonetowhompresentationistobemadeinaccordancewiththecollectioninstruction. fù kuǎn rén jí gēn jù tuō shōu zhǐ shì xiàng qí tí shì dān jù de rén。
B ． FormandStructureofCollections tuō shōu de xíng shì hé jié gòu
Article4
CollectionInstruction dì sì kuǎn tuō shōu zhǐ shì
Ai.AlldocumentssentforcollectionmustbeaccompaniedbyacollectioninstructionindicatingthatthecollectionissubjecttoURC522andgivingcompleteandpreciseinstructions.Banksareonlypermittedtoactupontheinstructionsgiveninsuchcollectioninstruction,andinaccordancewiththeseRules.
suǒ yòu sòng wǎng tuō shōu de dān jù bì xū fù yòu yī xiàng tuō shōu zhǐ shì， zhù míng gāi xiàng tuō shōu jiāng zūn xún《 tuō shōu tǒng yī guī zé 》 dì 522 hào wén jiàn bìng qiě liè chū wán zhěng hé míng què de zhǐ shì。 yínháng zhǐ zhǔn yǔn gēn jù gāi tuō shōu zhǐ shì zhōng de mìng lìng hé běn guī zé xíng shì；
ii.Bankswillnotexaminedocumentsinordertoobtaininstructions.
yínháng jiāng bù huì wèile qǔ dé zhǐ shì 'ér shěn hé dān jù；
iii.Unlessotherwiseauthorizedinthecollectioninstruction,bankswilldisregardanyinstructionsfromanyparty/bankotherthantheparty/bankfromwhomtheyreceivedthecollections.
chú fēi tuō shōu zhǐ shì zhōng lìng yòu shòu quán， yínháng jiāng bù lǐ huì lái zì chú liǎo tā suǒ shōu dào tuō shōu de yòu guān rén / yínháng yǐ wài de rèn hé yòu guān rén / yínháng de rèn hé zhǐ lìng。
BAcollectioninstructionshouldcontainthefollowingitemsofinformation,asappropriate.
tuō shōu zhǐ shì yīngdāng bāo kuò xià shù shì yí de gè xiàng nèi róng：
i.Detailsofthebankfromwhichthecollectionwasreceivedincludingfullname,postalandSWIFTaddresses,telex,telephone,facsimilenumbersandreference.
shōu dào gāi xiàng tuō shōu de yínháng xiáng qíng， bāo kuò quán chēng、 yóu zhèng hé SWIFT dì zhǐ、 diàn chuán、 diàn huà hé chuán zhēn hào mǎ hé biān hào；
ii.Detailsoftheprincipalincludingfullname,postaladdress,andifapplicabletelex,telephoneandfacsimilenumbers.
wěi tuō rén de xiáng qíng bāo kuò quán chēng、 yóu zhèng dì zhǐ huò zhě bàn lǐ tí shì de chǎng suǒ yǐ jí， rú guǒ yòu de huà， diàn chuán、 diàn huà hé chuán zhēn hào mǎ；
iii.Detailsofthedraweeincludingfullname,postaladdress,orthedomicileatwhichpresentationistobemadeandifapplicabletelex,telephoneandfacsimilenumbers.
fù kuǎn rén de xiáng qíng bāo kuò quán chēng、 yóu zhèng dì zhǐ huò zhě bàn lǐ tí shì de chǎng suǒ yǐ jí， rú guǒ yòu de huà， diàn chuán、 diàn huà hé chuán zhēn hào mǎ；
iv.Detailsofthepresentingbank,ifany,includingfullname,postaladdress,andifapplicabletelex,telephoneandfacsimilenumbers.
tí shì yínháng（ rú yòu de huà） de xiáng qíng， bāo kuò quán chēng、 yóu zhèng dì zhǐ yǐ jí， rú guǒ yòu de huà， diàn chuán hé chuán zhēn hào mǎ；
v.Amount(s)andcurrency(ies)tobecollected.
dài tuō shōu de jīn 'é hé huò bì；
vi.Listofdocumentsenclosedandthenumericalcountofeachdocument.

Itistheresponsibilityofthepartypreparingthecollectioninstructiontoensurethatthetermsforthedeliveryofdocumentsareclearlyandunambiguouslystated,otherwisebankswillnotberesponsibleforanyconsequencesarisingtherefrom.
shàn zhì tuō shōu zhǐ shì de yòu guān fāng yīngyǒu zé rèn qīng chǔ wú wù dì shuō míng， què bǎo dān jù jiāo fù de tiáo jiàn， fǒu zé de huà， yínháng duì cǐ suǒ chǎn shēng de rèn hé hòu guǒ jiāng bù chéng dān zé rèn；
viii.Chargestobecollected,indicatingwhethertheymaybewaivedornot.
dài shōu qǔ de shǒu xù fèi zhǐ míng shì fǒu kě yǐ fàng qì；
ix.Interesttobecollected,ifapplicable,indicatingwhetheritmaybewaivedornot,including:
a)rateofinterest
b)interestperiod
c)basisofcalculation(forexample360or365daysinyear)asapplicable.
dài shōu qǔ de lì xī， rú yòu de huà， zhǐ míng shì fǒu kě yǐ fàng qì， bāo kuò lìlǜ、 jì xī qī、 shì yòng de jì suàn qī jī shù（ rú yī nián 'àn 360 tiān hái shì 365 tiān）；
x.Methodofpaymentandformofpaymentadvice. fù kuǎn fāng fǎ hé fù kuǎn tōng zhī de xíng shì；
xi.Instructionsincaseofnon-payment,non-acceptanceand/ornon-compliancewithotherinstructions. fā shēng bù fù kuǎn、 bù chéng duì hé / huò yǔ qí tā pī shì bù xiāng fú shí de zhǐ shì。
i.Collectioninstructionsshouldbearthecompleteaddressofthedraweeorofthedomicileatwhichthepresentationistobemade.Iftheaddressisincompleteorincorrect,thecollectingbankmay,withoutanyliabilityandresponsibilityonitspart,endeavourtoascertaintheproperaddress.
tuō shōu zhǐ shì yìng zài míng fù kuǎn rén huò jiāng yào bàn lǐ tí shì chǎng suǒ de wán zhěng dì zhǐ。 rú guǒ dì zhǐ bù quán huò yòu cuò wù， dài shōu yín xíng kě jìn lì qù chá míng qiàdàng de dì zhǐ， dàn qí běn shēn bìng wú yì wù hé zé rèn。
ii.Thecollectingbankwillnotbeliableorresponsibleforanyensuingdelayasaresultofanincompleteorincorrectaddressbeingprovided.
dài shōu yínháng duì yīn suǒ tí gōng dì zhǐ bù quán huò yòu wù suǒ zào chéng de rèn hé yán wù jiāng bù chéng dān zé rèn huò duì qí fù zé。
B.FormofPresentation tí shì de xíng shì

Presentation dì wǔ kuǎn tí shì
a.ForthepurposesoftheseArticles,presentationistheprocedurewherebythepresentingbankmakesthedocumentsavailabletothedraweeasinstructed.
jiù běn tiáo kuǎn 'ér yán， tí shì shì biǎo shì yínháng 'àn zhào zhǐ shì shǐ dān jù duì fù kuǎn rén fā shēng yòu xiào yòng de chéng xù。
b.Thecollectioninstructionshouldstatetheexactperiodoftimewithinwhichanyactionistobetakenbythedrawee.
tuō shōu zhǐ shì yìng liè míng fù kuǎn rén jiāng yào cǎi qǔ xíng dòng díquè qiē qī xiàn。
Expressionssuchas“ first” ,“ prompt” ,“ immediate” ,andthelikeshouldnotbeusedinconnectionwithpresentationorwithreferencetoanyperiodoftimewithinwhichdocumentshavetobetakenuporforanyotheractionthatistobetakenbythedrawee.Ifsuchtermsareusedbankswilldisregardthem.
zhū rú shǒu xiān、 xùn sù、 lì jí hé lèi sì de biǎo shù bù yìng yòng yú tí shì、 huò fù kuǎn rén shú dān cǎi qǔ rèn hé qí tā xíng dòng de rèn hé qī xiàn。 rú guǒ cǎi yòng liǎo gāi lèi shù yǔ， yínháng jiāng bù yú lǐ huì。
c.Documentsaretobepresentedtothedraweeintheforminwhichtheyarereceived,exceptthatbanksareauthorizedtoaffixanynecessarystamps,attheexpenseofthepartyfromwhomtheyreceivedthecollectionunlessotherwiseinstructed,andtomakeanynecessaryendorsementsorplaceanyrubberstampsorotheridentifyingmarksorsymbolscustomarytoorrequiredforthecollectionoperation.
dān jù bì xū yǐ yínháng shōu dào shí de xíng tài xiàng fù kuǎn rén tí shì， chú fēi bèi shòu quán tiē fù rèn hé bì xū de yìn huā、 chú fēi lìng yòu zhǐ shì fèi yòng yóu xiàng qí fā chū tuō shōu de yòu guān fāng zhī fù yǐ jí bèi shòu quán cǎi qǔ rèn hé bì yào de bèi shū huò jiā gài xiàng pí chuō jì， huò qí tā tuō shōu yè wù guàn yòng de hé bì yào de biàn rèn jì hào huò fú hào。
d.Forthepurposeofgivingeffecttotheinstructionsoftheprincipal,theremittingbankwillutilizethebanknominatedbytheprincipalasthecollectingbank.Intheabsenceofsuchnomination,theremittingbankwillutilizeanybankofitsown,oranotherbank ’ schoiceinthecountryofpaymentoracceptanceorinthecountrywhereothertermsandconditionshavetobecompliedwith.
wèile shǐ wěi tuō rén de zhǐ shì dé yǐ shí xiàn， jì dān xíng jiāng yǐ wěi tuō rén suǒ zhǐ dìng de yínháng zuò wéi dài shōu xíng。 zài wèi zhǐ dìng dài shōu xíng shí， jì dān xíng jiāng shǐ yòng tā zì shēn de rèn hé yínháng huò zhě zài fù kuǎn huò chéng duì de guó jiā zhōng， huò zài bì xū zūn shǒu qí tā tiáo jiàn de guó jiā zhòngxuǎn zé lìng wài de yínháng。
e.Thedocumentsandcollectioninstructionmaybesentdirectlybytheremittingbanktothecollectingbankorthroughanotherbankasintermediary.
dān jù hé tuō shōu zhǐ shì kě yǐ yóu jì dān xíng zhí jiē huò zhě tōng guò； lìng yī yínháng zuò wéi zhōng jiān yínháng jì sòng gěi dài shōu xíng。
f.Iftheremittingbankdoesnotnominateaspecificpresentingbank,thecollectingbankmayutilizeapresentingbankofitschoice.

Sight/Acceptance dì liù kuǎn jí qī / chéng duì
Inthecaseofdocumentspayableatsightthepresentingbankmustmakepresentationforpaymentwithoutdelay.
Inthecaseofdocumentspayableatatenorotherthansightthepresentingbankmust,whereacceptanceiscalledfor,makepresentationforacceptancewithoutdelay,andwherepaymentiscalledfor,makepresentationforpaymentnotlaterthantheappropriatematuritydate.
rú guǒ shì jiàn dān jí fù de dān jù， tí shì xíng bì xū lì jí bàn lǐ tí shì fù kuǎn bù dé yán wù； rú guǒ bù shì jí qī 'ér shì yuǎn qī fù kuǎn dān jù， tí shì xíng bì xū zài bù wǎn yú yìng dào qī rì， rú shì yào chéng duì lì jí bàn lǐ tí shì chéng duì、 rú shì fù kuǎn shí lì jí bàn lǐ tí shì fù kuǎn。

a.Collectionshouldnotcontainbillsofexchangepayableatafuturedatewithinstructionthatcommercialdocumentsaretobedeliveredagainstpayment.
fù yòu shāng yè dān jù bì xū zài fù kuǎn shí jiāo chū de tuō shōu zhǐ shì， bù yìng bāo hán yuǎn qī fù kuǎn de huì piào。
b.Ifacollectioncontainsabillofexchangepayableatafuturedate,thecollectioninstructionshouldstatewhetherthecommercialdocumentsaretobereleasedtothedraweeagainstacceptance(D/A)oragainstpayment(D/P).
Intheabsenceofsuchstatementcommercialdocumentswillbereleasedonlyagainstpaymentandthecollectingbankwillnotberesponsibleforanyconsequencesarisingoutofanydelayinthedeliveryofdocuments.

c.Ifacollectioncontainsabillofexchangepayableatafuturedateandthecollectioninstructionindicatesthatcommercialdocumentsaretobereleasedagainstpayment,documentswillbereleasedonlyagainstsuchpaymentandthecollectingbankwillnotberesponsibleforanyconsequencesarisingoutofanydelayinthedeliveryofdocuments.

Wheretheremittingbankinstructsthateitherthecollectingbankorthedraweeistocreatedocuments(billsofexchangepromissorynotes,trustreceipts,lettersofundertakingorotherdocuments)thatwerenotincludedinthecollection,theformandwordingofsuchdocumentsshallbeprovidedbytheremittingbank,otherwisethecollectingbankshallnotbeliableorresponsiblefortheformandwordingofanysuchdocumentprovidedbythecollectingbankand/orthedrawee.

Nevertheless,intheeventthatgoodsaredispatcheddirectlytotheaddressofabankorconsignedtoortotheorderofabankforreleasetoadraweeagainstpaymentoracceptanceoruponothertermsandconditionswithoutprioragreementonthepartofthatbank,suchbankshallhavenoobligationtotakedeliveryofthegoods,whichremainattheriskandresponsibilityofthepartydispatchingthegoods.

c.Nevertheless,inthecasethatbankstakeactionfortheprotectionofthegoods,whetherinstructedornot,theyassumenoliabilityorresponsibilitywithregardtothefateand/orconditionofthegoodsand/orforanyactsand/oromissionsonthepartofanythirdpartiesentrustedwiththecustodyand/orprotectionofthegoods.However,thecollectingbankmustadvisewithoutdelaythebankfromwhichthecollectioninstructionwasreceivedofanysuchactiontaken.

PaymentWithoutDelay lì jí huì fù
a.Amountscollected(lesschargesand/ordisbursementsand/orexpenseswhereapplicable)mustbemadeavailablewithoutdelaytothepartyfromwhomthecollectioninstructionwasreceivedinaccordancewiththetermsandconditionsofthecollectioninstruction.
shōu tuǒ de kuǎn xiàng（ kòu chú shǒu xù fèi hé / huò zhī chū hé / huò kě néng de huà xiāo） bì xū 'àn zhào tuō shōu zhǐ shì zhōng guī dìng de tiáo jiàn hé tiáo kuǎn bù yán wù dì fù gěi cóng qí shōu dào tuō shōu zhǐ shì de yī fāng， bù dé yán wù；
b.Notwithstandingtheprovisionsofsub-article1(c)andunlessotherwiseagreed,thecollectingbankwilleffectpaymentoftheamountscollectedinfavouroftheremittingbankonly.

PaymentinLocalCurrency yǐ dāng dì huò bì zhī fù
Inthecaseofdocumentspayableinthecurrencyofthecountryofpayment(localcurrency),thepresentingbankmust,unlessotherwiseinstructedinthecollectioninstruction,releasethedocumentstothedraweeagainstpaymentinlocalcurrencyonlyifsuchcurrencyisimmediatelyavailablefordisposalinthemannerspecifiedinthecollectioninstruction.

Inthecaseofdocumentspayableinacurrencyotherthanofthecountryofpayment(foreigncurrency),thepresentingbankmust,unlessotherwiseinstructedinthecollectioninstruction,releasethedocumentstothedraweeagainstpaymentinthedesignedforeigncurrencyonlyifsuchforeigncurrencycanimmediatelyremittedinaccordancewiththeinstructionsgiveninthecollectioninstruction.

PartialPayments fēn qī fù kuǎn
a.Inrespectofcleancollections,partialpaymentsmaybeacceptedifandtotheextenttowhichandontheconditionsonwhichpartialpaymentsareauthorizedbythelawinforceintheplaceofpayment.Thefinancialdocument(s)willbereleasedtothedraweeonlywhenfullpaymentthereofhasbeenreceived.

b.Inrespectofdocumentarycollection,partialpaymentswillonlybeacceptedifspecificallyauthorizedinthecollectioninstruction.However,unlessotherwiseinstructed,thepresentingbankwillreleasethedocumentstothedraweeonlyafterfullpaymenthasbeenreceived,andthepresentingbankwillnotberesponsibleforanyconsequencearisingoutofanydelayinthedeliveryofdocuments.

Interest
a.Ifthecollectioninstructionspecifiesthatinterestistobecollectedandthedraweerefusestopaysuchinterest,thepresentingbankmaydeliverthedocument(s)againstpaymentofacceptanceoronothertermsandconditionsasthecasemaybe,withoutcollectingsuchinterest,unlesssub-article20(c)applies.

b.Wheresuchinterestistobecollected,thecollectioninstructionmustspecifytherateofinterest,interestperiodandbasisofcalculation.
rú guǒ yào qiú shōu qǔ lì xī， tuō shōu zhǐ shì zhōng yìng míng què guī dìng lìlǜ、 jì xī qī hé jì xī fāng fǎ。
c.Wherethecollectioninstructionexpresslystatesthatinterestmaynotbewaivedandthedraweerefusestopaysuchinterestthepresentingbankwillnotdeliverdocumentandwillnotberesponsibleforanyconsequencesarisingoutofanydelayinthedeliveryofdocument(s).Whenpaymentofinteresthasbeenrefused,thepresentingbankmustinformbytelecommunicationor,ifthatisnotpossible,byotherexpeditiousmeanswithoutdelaythebankfromwhichthecollectioninstructionwasreceived.
rú tuō shōu zhǐ shì zhōng míng què dì zhǐ míng lì xī bù dé fàng qì 'ér fù kuǎn rén yǐ jù fù gāi lì xī， tí shì xíng jiāng bù jiāo dān， bìng duì yóu cǐ suǒ yǐn qǐ de yán chí jiāo dān suǒ chǎn shēng de hòu guǒ jiāng bù chéng dān zé rèn。 dāng lì xī yǐ bèi jù fù shí， tí shì xíng bì xū yǐ diàn xùn， dāng bù kě néng shí kě yòng qí tā biàn jié de fāng shì tōng zhī céng xiàng qí fā chū tuō shōu zhǐ shì de yínháng， bù dé yán wù。

ChargesandExpenses shǒu xù fèi hé fèi yòng
a.Ifthecollectioninstructionspecifiesthatcollectionchargesand/orexpensesaretobeofaccountofthedraweeandthedraweerefusestopaythem,thepresentingbankmaydeliverthedocument(s)againstpaymentoracceptanceoronothertermsandconditionsasthecasemaybe,withoutcollectingchargesand/orexpenses,unlesssub-article21(b)applies.
Whenevercollectionchargesand/orexpensesaresowaivedtheywillbefortheaccountofthepartyfromwhomthecollectionwasreceivedandmaybedeductedfromtheproceeds.

b.Wherethecollectioninstructionexpresslystatesthatchargesand/orexpensesmaynotbewaivedandthedraweerefusestopaysuchchargesand/orexpenses,thepresentingbankwillnotdeliverdocumentsandwillnotberesponsibleforanyconsequencearisingoutofanydelayinthedeliveryofthedocument(s).Whenpaymentofcollectionchargesand/orexpenseshasbeenrefusedthepresentingbankmustinformbytelecommunicationor,ifthatisnotpossible,byotherexpeditiousmeanswithoutdelaythebankfromwhichthecollectioninstructionwasreceived.

c.InallcaseswhereintheexpresstermsofacollectioninstructionorundertheseRules,disbursementsand/orexpensesand/orcollectionchargesaretobebornebytheprincipal,thecollectingbank(s)shallbeentitledtorecoverpromptlyoutlaysinrespectofdisbursements,expensesandchargesfromthebankformwhichthecollectioninstructionwasreceived,andtheremittingbankshallbeentitledtorecoverpromptlyfromtheprincipalanyamountsopaidoutbyit,togetherwithitsowndisbursements,expensesandcharges,regardlessofthefateofthecollection.

Acceptance
Thepresentingbankisresponsibleforseeingthattheformoftheacceptanceofabillofexchangeappearstobecompleteandcorrect,butisnotresponsibleforthegenuinenessofanysignatureorfortheauthorityofanysignatorytosigntheacceptance.

Thepresentingbankisnotresponsibleforthegenuinenessofanysignatureorfortheauthorityofanysignaturetosignapromissorynote,receipt,orotherinstruments.

Protest jù jué zhèng shū
Thecollectioninstructionshouldgivespecificinstructionsregardingprotest(orotherlegalprocessinlieuthereof),intheeventofnon-paymentornon-acceptance.
Intheabsenceofsuchspecificinstructions,thebanksconcernedwiththecollectionhavenoobligationtohavethedocument(s)protested(orsubjectedtootherlegalprocessinlieuthereof)fornon-paymentornon-acceptance.
Anychargesand/orexpensesincurredbybanksinconnectionwithsuchprotest,orotherlegalprocess,willbefortheaccountofthepartyfromwhomthecollectioninstructionwasreceived.

Iftheprincipalnominatesarepresentativetoactascase-of-needintheeventofnon-paymentand/ornon-acceptancethecollectioninstructionshouldclearlyandfullyindicatethepowersofsuchcase-of-need.Intheabsenceofsuchindicationbankswillnotacceptanyinstructionsfromthecase-of-need.

a.FormofAdvise tōng zhī gé shì
Alladvicesofinformationfromthecollectingbanktothebankfromwhichthecollectioninstructionwasreceived,mustbearappropriatedetailsincluding,inallcases,thelatterbank’ sreferenceasstatedinthecollectioninstruction.
dài shōu xíng duì xiàng qí fā chū tuō shōu zhǐ shì de yínháng jǐyǔ suǒ yòu tōng zhī hé xìn xī bì xū yào yòu xiāng yìng de xiáng qíng， zài rèn hé qíng kuàng xià dū yìng bāo kuò hòu zhě zài tuō shōu zhǐ shì zhōng liè míng de yínháng yè wù biān hào。
b.MethodofAdvice tōng zhī de fāng fǎ：
Itshallbetheresponsibilityoftheremittingbanktoinstructthecollectingbankregardingthemethodbywhichtheadvicesdetailedin(c)i,(c)iiand(c)iiiaretobegiven.Intheabsenceofsuchinstructions,thecollectingbankwillsendtherelativeadvicesbythemethodofitschoiceattheexpenseofthebankfromwhichthecollectioninstructionwasreceived.

Thepresentingbankmustsendwithoutdelayadviceofnon-paymentand/oradviceofnon-acceptancetothebankformwhichitreceivedthecollectioninstruction.
Onreceiptofsuchadvicetheremittingbankmustgiveappropriateinstructionsastothefurtherhandlingofthedocuments.Ifsuchinstructionsarenotreceivedbythepresentingbankwithin60daysafteritsadviceofnon-paymentand/ornon-acceptance,thedocumentsmaybereturnedtothebankfromwhichthecollectioninstructionwasreceivedwithoutanyfurtherresponsibilityonthepartofthepresentingbank
